Update April 3, 2025: Fenchak V Penn State BOT

This Friday, April 11th 2025 there will be a hearing in Judge Marshall’s courtroom in the Centre County Courthouse Annex at 1:30 pm (April 7th update: this time has been changed from the initially announced 2 pm time)

The public may attend, and if you are in the area this might be a very interesting afternoon.

Judge Marshall has scheduled this hearing so we can present arguments as to why he should grant our Emergency Motion for Preliminary Injunction to compel the Penn State Board of Trustees to put me back on the Alumni Trustee ballot. Penn State, which is under a court ordered injunction to not vote to remove me, will be present to defend their most recent actions and the legitimacy of their newly enacted amended Bylaws, which we feel violate the Pennsylvania Constitution and state statutes.

You can read our Plaintiff’s Complaint for Declaratory Relief here, which lays out our argument. Penn State’s reply is due this Wednesday and I will post it here on my website.

Our legal team from Obermayer Rebmann Maxwell & Hippel LLP will be there, as will I. Your support means a lot, and I appreciate it. I am fighting for the alumna’s right to vote for any qualified alumni trustee candidate, a right they’ve had for the last 150 years. It has been an honor and a privilege to represent the alumni for one term as a Penn State trustee, and I hope to be elected to serve another.

Judge Marshall’s courtroom is directly across the street from the main Centre County Courthouse in Bellefonte, and next to the Dominos Pizza.

Time: The hearing is scheduled for 1:30 pm, Friday April 11th.

Parking: There is metered street parking, and some municipal lots. Do not park on streets with red lined curbs.

Security: Please be prepared to pass through security screening.

As a member of the Penn State Board of Trustees, I will from time to time be made aware of certain confidential information. Any public opinions or statements made now or in the past are from me, individually, and not by or on behalf of the Board of Trustees. I will also engage with Trustees and administrators in private, off-the-record conversations, with the expectation of privacy on both parties.
